Georgia HB 399: What Rental Property Owners Need to Know
If you own rental property in Georgia, especially if you live outside the state, there’s an important law you should know about.
Georgia House Bill 399 (HB 399) became effective July 1, 2025, and changes some of the rules surrounding who can manage rental and other real estate in Georgia.
What Does HB 399 Mean in Plain English?
For out-of-state owners of single-family homes and duplexes, Georgia now requires an in-state presence to help ensure that tenant communications and property issues can be handled locally.
The law also makes important changes to Georgia’s real estate licensing exemptions. Previously, certain full-time employees of property owners could perform property management activities without holding a real estate license. HB 399 significantly narrows that exemption.
That change can affect owners of both residential and commercial real estate.
There are still exemptions for certain owners and ownership structures, including provisions designed for some family-owned and “mom-and-pop” operations, so every property owner’s situation may not be the same.
Why Did Georgia Make the Change?
Think of it as accountability + accessibility.
If a tenant has an issue, maintenance is needed, or local code enforcement needs to communicate about a property, there should be an appropriate person available to respond.
HB 399 also strengthens professional licensing requirements for people performing real estate management activities on behalf of property owners.
For out-of-state investors, that means owning Georgia real estate may require more than having someone you know locally “keep an eye on things.”
